These Terms & Conditions apply to tours and activities offered GUATERIDE, trading as DownhillRabbit, a company established in Guatemala ("GUATERIDE", "we", "us", or "our").

By making a direct booking with GUATERIDE, the person making the booking confirms that they have read and accepted these Terms & Conditions and, where booking for other participants, will ensure that all participants receive the relevant safety and participation information.

2. Bookings and Payment

Direct bookings are confirmed once the required booking information has been provided and full payment has been successfully received.

Prices may be displayed and charged in USD or GTQ. Currency conversion charges or fees applied by a customer's bank, card issuer, payment provider, or another third party are outside GuateRide's control.

Bookings made through third-party platforms such as Viator or Tripadvisor may additionally be subject to the terms, payment conditions, and cancellation policies of that platform.

3. Participation Requirements

Participants must:

• be at least 15 years old;

• be comfortable and confident riding a regular bicycle;

• follow all reasonable safety instructions given by the guide;

• wear a properly fitted helmet while riding;

• operate the e-bike responsibly; and

• behave in a manner that does not create an unreasonable risk to themselves or others.

Previous e-bike experience is not required.

Participants aged 15–17 must be accompanied by a parent or legal guardian or have prior written authorization from a parent or legal guardian, subject to acceptance by GuateRide.

4. Safety and Helmet Requirements

Before departure, participants receive instructions on how to operate the e-bike and a safety briefing.

Helmets are mandatory while riding. GuateRide provides helmets to participants.

A participant who refuses to wear a helmet or materially fails to follow safety instructions may not participate or may be removed from the activity.

GuateRide may refuse or discontinue participation when the guide reasonably considers that continuing would create a material safety risk. This may include inability to control the bicycle safely, dangerous behavior, intoxication, or refusal to follow safety instructions.

Where participation is refused or terminated because of a participant's unsafe behavior, intoxication, inability to meet the stated participation requirements, or material failure to follow safety instructions, no refund will normally be provided, except where applicable law requires otherwise.

5. Alcohol and Drugs

Participants may not participate while under the influence of alcohol, illegal drugs, or another substance that materially impairs their ability to ride safely.

The guide may refuse or terminate participation where impairment creates a safety concern.

6. Nature and Risks of the Activity

Cycling and e-biking are outdoor physical activities involving inherent risks.

Tours may include public roads, motor vehicles, pedestrians, intersections, hills, descents, cobblestones, uneven or slippery surfaces, changing weather conditions, obstacles, animals, and other conditions outside GuateRide's direct control.

These risks may include falls, collisions, property damage, bodily injury, serious injury, permanent disability and, in rare circumstances, death.

Participants are expected to exercise reasonable care, remain attentive, ride according to their ability, and follow the guide's instructions.

7. Health and Ability to Participate

Each participant is responsible for determining whether they are reasonably capable of safely participating in an e-bike tour.

Participants who are pregnant or who have a medical or physical condition that could materially affect their ability to participate safely should consider whether the activity is appropriate for them and seek professional medical advice where appropriate.

Participants are not required to provide unnecessary medical information to GuateRide. However, information reasonably necessary for the safe conduct of the activity should be communicated to the guide where appropriate.

8. Arrival and Late Arrival

Participants should arrive at the meeting point 15 minutes before the scheduled departure for bike setup, helmet fitting, and the safety briefing.

Participants arriving more than 15 minutes after the scheduled departure time may be treated as a no-show if the tour has already departed or waiting would materially affect the experience of other guests.

Late arrivals and no-shows are non-refundable, except where applicable law requires otherwise.

9. Tour Routes and Itineraries

Tour descriptions and itineraries represent the intended experience but may need to be reasonably changed due to weather, traffic, road closures, safety considerations, local conditions, third-party venue availability, or circumstances outside GuateRide's reasonable control.

Where reasonably possible, GuateRide will provide a comparable alternative.

Reasonable changes to the route, sequence of stops, timing, or itinerary do not automatically entitle a participant to a refund.

10. Weather

Tours may operate in light rain.

GuateRide may postpone, modify, or cancel a tour when weather, road, or other conditions make the activity unsafe.

If GuateRide cancels the entire tour due to unsafe conditions before the tour takes place, customers may choose between:

• rescheduling without additional charge; or

• receiving a full refund of the amount paid directly to GuateRide for that tour.

11. Customer Cancellations

Direct bookings may be cancelled or rescheduled without charge up to 24 hours before the scheduled departure time.

Cancellations made less than 24 hours before departure and no-shows are non-refundable, except where mandatory law provides otherwise.

Bookings made through third-party booking platforms are subject to the cancellation conditions applicable to the booking on that platform.

12. E-Bikes and Equipment

Participants must use GuateRide's e-bikes, helmets, and other equipment responsibly and in accordance with the instructions provided.

Normal wear and tear and damage not attributable to the participant will not be charged to the participant.

Where a participant intentionally or negligently causes identifiable damage to an e-bike or other equipment, GuateRide reserves the right to seek reasonable compensation for the actual damage caused, subject to applicable law.

13. Responsibility and Liability

Participation in an e-bike tour involves inherent risks that cannot be completely eliminated even when reasonable safety measures are taken.

Participants voluntarily accept the inherent risks normally associated with cycling and e-biking and remain responsible for their own conduct, compliance with safety instructions, and responsible operation of the bicycle.

To the maximum extent permitted by applicable Guatemalan law, GuateRide is not responsible for injury, loss, damage, or death resulting solely from inherent risks of cycling or e-biking that are not caused by a legally attributable act or omission of GuateRide or a person for whom GuateRide is legally responsible.

Nothing in these Terms excludes, waives, or limits any right, remedy, or liability that cannot lawfully be excluded, waived, or limited under applicable Guatemalan law.

14. Personal Belongings

Participants are responsible for their personal belongings during the tour and should bring only items that can be carried safely while cycling.

Nothing in this provision limits any responsibility that cannot legally be excluded.

15. Third-Party Services and Locations

Some experiences may include visits to independently operated locations such as museums, cultural venues, cafés, or other establishments.

These third parties may operate under their own rules, schedules, availability, and safety requirements.

GuateRide will make reasonable efforts to provide the advertised experience but cannot guarantee the uninterrupted operation or availability of an independent third-party venue.

16. Photography and Video

GuateRide may take photographs or videos during tours.

Participation in a tour does not automatically constitute consent to commercial or marketing use of a participant's identifiable image.

Where GuateRide wishes to use identifiable images for its website, social media, advertising, or other promotional purposes, consent will be requested separately where appropriate.

Declining marketing consent will not affect a customer's ability to participate.

17. Complaints

If you experience a problem during your tour, please inform your guide as soon as reasonably possible so that GuateRide has an opportunity to address it.

Nothing in these Terms limits a consumer's right to seek remedies or submit complaints to competent authorities.

18. Governing Law

These Terms are governed by the applicable laws of the Republic of Guatemala, without limiting mandatory consumer protection rights.

19. Language

These Terms are available in English and Spanish.

he Spanish-language version is intended to serve as the primary contractual version in Guatemala, subject to applicable law. In the event of an inconsistency, the Spanish version will prevail to the extent legally permissible.
